Last updated: 21 July 2026
1. About these terms
This website (marcx.com.au, the “Site”) is owned and operated by Marcx Digital Pty Ltd (ABN 29 700 489 596) (“Marcx Digital”, “we”, “us” or “our”), based in Queensland, Australia. By accessing or using the Site you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.
2. Purpose of the Site
The Site is a portfolio and information site showcasing our services, capabilities and the platforms we work with. No goods or services are sold through the Site, and no payments or transactions are processed on the Site. Any engagement of our services occurs under a separate agreement between you and us, and nothing on the Site constitutes an offer capable of acceptance.
3. Information only — no advice
The content on the Site (including articles and resources) is provided for general information purposes only. It does not constitute professional, marketing, financial, legal or other advice, and it does not take your particular circumstances into account. You should not rely on Site content as a substitute for advice tailored to your situation. While we take care to keep content accurate and current, we make no warranty that any content is complete, accurate or up to date.
4. Intellectual property
Unless otherwise indicated, all content on the Site — including text, graphics, logos, page designs, articles and downloadable resources — is owned by or licensed to us and is protected by Australian and international intellectual property laws.
You may view the Site and print or download content for your personal, non-commercial use. You must not otherwise reproduce, modify, distribute, republish or commercially exploit any Site content without our prior written consent.
Where the Site displays work created for clients, client names, logos or testimonials, those materials remain the property of their respective owners and are displayed with permission for portfolio purposes only. They must not be copied or reused, and their display does not imply that any client endorses the Site or anything on it beyond the words of their own testimonial.
5. Acceptable use
You must not use the Site in any way that is unlawful, that damages or disrupts the Site or its infrastructure, that attempts to gain unauthorised access to any systems or data, or that scrapes, harvests or mass-downloads Site content (including for training machine-learning systems) without our written consent.
6. Third-party links and affiliate disclosure
The Site may contain links to third-party websites, platforms and tools. These links are provided for convenience only. We do not control third-party sites and are not responsible for their content, their privacy practices or anything you acquire from them. Linking does not imply our endorsement.
Some links on the Site may in future be affiliate or referral links, meaning we may receive a commission or other benefit if you click through and make a purchase or sign up. Where a link is an affiliate link, this does not affect the price you pay. Any opinions or recommendations we publish remain our own.
7. Liability
To the maximum extent permitted by law, we exclude all liability for any loss or damage (including indirect or consequential loss, and loss of profit, data or opportunity) arising from your use of, or reliance on, the Site or its content, or from any interruption, error or virus associated with the Site.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.
8. Privacy
Our collection and handling of personal information through the Site is governed by our Privacy Policy, which forms part of these Terms.
9. Changes and availability
We may update these Terms, and change or discontinue any part of the Site, at any time without notice. The current version of these Terms will always be published on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. We do not guarantee that the Site will be available at all times or free from faults.
